Terms of Service
- Hosk helps you keep your fleet’s books. It is in early access, so it may change and may contain mistakes.
- Your data stays yours. You give us permission to use it only to run Hosk for you.
- Hosk is not tax, legal, accounting or financial advice. Check important numbers before relying on them.
- Pennsylvania law applies.
1. Agreement
These Terms are an agreement between you and Surge LLC, a Pennsylvania limited liability company (“Hosk”, “we”, “us”). By using the Hosk website or app, QuikPic, Hosk AI or email forwarding (the “Service”), you agree to these Terms and to our Privacy Policy. If you use Hosk for a company, you agree for that company and confirm you may do so.
2. Who can use Hosk
You must be at least 18 and able to form a binding contract. Hosk is built for car-sharing hosts and other vehicle businesses.
3. Early access
Hosk is in early access. Features may change, pause or stop, and the Service may have errors or downtime. We will try to give notice of major changes.
4. Your account
Keep your sign-in private. You are responsible for activity under your account. Tell us right away at hello@gethosk.com if you think someone else has access.
5. Your data
You own the data you upload or connect (“Your Data”). You give us a limited permission to store, copy, process and display Your Data only to provide, secure and improve the Service for you, as described in the Privacy Policy. You can download a backup of Your Data at any time.
You confirm that you have the right to upload Your Data, including your guests’ information from Turo exports, tickets and claims, and that doing so doesn’t break Turo’s terms, your agreements with others or the law.
6. Connected services
Hosk connects to services run by other companies, such as Plaid (banks), Bouncie (trackers) and Anthropic (AI). Your use of those services is also governed by their terms. By connecting a bank, you authorize Plaid to access your account information and share it with Hosk. We are not responsible for other companies’ services, and Hosk may stop working with one if that company changes or ends its service. Hosk is not affiliated with Turo.
7. AI and automatic sorting
Hosk uses automated rules and AI to read documents, sort charges, match cars and guests, and estimate things like accuracy and dates. These results can be wrong. Review them, especially before filing taxes, billing a guest, filing a claim or making a financial decision. You can change or undo what Hosk does.
8. Not professional advice
Hosk provides information and tools. It is not tax, accounting, legal, insurance or financial advice. Talk to a qualified professional about your situation.
9. Acceptable use
Don’t use Hosk to break the law or anyone’s rights; upload data you don’t have the right to use; try to access other people’s accounts or data; probe, overload or attack the Service; copy, resell or reverse engineer it; or upload malware.
10. Fees
Hosk is free during early access. If we introduce paid plans, we will show the price before you agree, and you will not be charged unless you choose a paid plan. Refunds are covered by our Refund Policy.
11. Our property
The Service, including its software, design, the Hosk and QuikPic names and logos, belongs to Surge LLC. These Terms don’t give you any right to them except to use the Service. If you send us feedback, we may use it without owing you anything.
12. Ending use
You can stop using Hosk at any time, download a backup, and ask us to delete your account. We may suspend or end access if you break these Terms or if needed to protect the Service or others. Where we can, we will warn you first and give you a chance to download your data.
13. Disclaimers
To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement.
14. Limit of liability
To the extent the law allows, Surge LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some places don’t allow these limits, so they may not apply to you.
15. Indemnity
If someone makes a claim against us because of Your Data or your breach of these Terms, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
16. Disputes
Please contact us first at hello@gethosk.com. Most problems can be solved that way. If not, these Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules, and any dispute will be decided by the state or federal courts located in Pennsylvania.
17. Changes
We may update these Terms. We will change the date at the top and, for significant changes, tell you in Hosk or by email before they take effect. Using Hosk after that means you accept the new Terms.
18. Other terms
If part of these Terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver. You may not transfer these Terms without our consent; we may transfer them with the business. These Terms and the policies they link to are the whole agreement about the Service.
